Law, Ethics, Confidentiality and Boundaries-San Diego

This workshop is designed for counselors, licensed therapists, and staff working in mental health, addiction treatment or case management.

 Course Description: This workshop provides a review and update of legal and ethical concerns, including situations which pose the greatest risk for counselors and licensed therapists. Professional boundaries and codes of ethics will be discussed, and case studies will include ethical decision making in difficult situations in mental health and drug and alcohol treatment settings. State and federal laws will be reviewed including mandatory reporting / permissive disclosure and informed consent for adults and minors. Risk reduction will be examined including informed consent, record keeping, termination, and suggestions for documentation with high risk clients. The course will also review privacy, privilege, confidentiality, Federal CFR 42 Part 2, and HIPAA regulations.

Training Objectives

• Discuss state and federal laws regarding reporting of child abuse, elder abuse and duty to warn/duty to protect
• Identify issues surrounding privacy, confidentiality, permissive disclosure and privilege with regard to treatment records and release of information
• Discuss dual and multiple relationship and boundary violations
• Identify effective risk management strategies
• Review how and when to respond to subpoenas and court orders
